Implementation of Certain New Controls on Emerging Technologies Agreed at Wassenaar Arrangement 2019 Plenary

This final rule implements multilateral controls on six recently developed or developing technologies, which were identified by the Wassenaar Arrangement (WA) December 2019 WA Plenary Meeting in a manner contemplated by the Export Control Reform Act of 2018 (ECRA) to identify emerging technologies that are essential to U.S. national security.  The six emerging technologies are:

  • Hybrid additive manufacturing (AM)/computer numerically controlled (CNC) tools (2B001),
  • Computational lithography software designed for the fabrication of extreme ultraviolet (EUV) masks (3D003),
  • Technology for finishing wafers for 5nm production (new ECCN 3E004),
  • Digital forensics tools that circumvent authentication or authorization controls on a computer (or communications device) and extract raw data (5A004.b),
  • Software for monitoring and analysis of communications and metadata acquired from a telecommunications service provider via a handover interface (5D001.e), and
  • Sub-orbital craft (9A004.h, 9A515.a).

This rule harmonizes the CCL with the WA December 2019 Plenary Meeting agreements that pertain to these six technologies.  As these six technologies are recently developed or developing technologies that are essential to the national security of the United States, early implementation of the applicable WA December 2019 Plenary agreements is warranted.  The remaining WA 2019 Plenary agreements will be implemented in a separate rule.

Localisation programs have a long tradition in the UAE. While the defense industry has typically used so-called “offset” or Industrial Cooperation programs; ADNOC has launched an In-Country Value (ICV) program, which was followed by the Abu Dhabi Value (ADV) program soft-launched by the Department of Economic Development (DED) in Abu Dhabi. Offset and ICV/ADV programs are procurement-driven and require a reciprocal economic contribution to the UAE, of a designated percentage of the value of the contract awarded. Foreign defense companies are granted offset credits under the Tawazun program in exchange for meeting their localisation commitments. Under the ICV/ADV programs, suppliers are granted a localisation score based on their local “footprint”.

Agenda

  1. Registration & Networking
  2. Welcome Address
    Oliver Oehms, CEO, German Emirati Joint Council for Industry & Commerce (AHK)
  3. Legal Insights on
    – ADNOC’s In-Country Value Program (ICV);
